2. Counter-Notification
If you believe that the material removed or disabled as a result of a DMCA complaint was wrongly taken down or you have the legal right to use the material, you may file a counter-notification with our designated agent. Your counter-notification must include the following information:

  • Consent to Jurisdiction: A statement that you consent to the jurisdiction of the federal district court for the district in which your address is located, or if you are located outside the United States, that you consent to the jurisdiction of any federal district court in which Erabill may be found, and that you will accept service of process from the person who submitted the original DMCA complaint or an agent of that person.
  • Accuracy Statement: A statement that the information provided in your counter-notification is accurate and that you have the right to use the material in question.

3. DMCA Policy Enforcement
Upon receipt of a valid DMCA takedown notice, Erabill will promptly remove or disable access to the allegedly infringing content. We will also notify the user who posted the material of the takedown and provide them with a copy of the notice. If we receive a valid counter-notification, we may restore the removed content unless the copyright owner files a lawsuit within 10 business days to prevent its reinstatement.

4. Repeat Infringers
Erabill has a policy of terminating, in appropriate circumstances, users or account holders who are deemed to be repeat infringers. Users who repeatedly post content that infringes the intellectual property rights of others will have their access to our services terminated.

5. Limitation of Liability
Erabill is not responsible for any content uploaded, posted, or transmitted by users. We will not be liable for any damages of any kind related to claims of copyright infringement, removal of content, or actions taken in response to DMCA notices.
